THIS AGREEMENT is made between ©2016-19 Aqaar Network FZ LLC.and you ("the User").

©2016-19 Aqaar Network FZ LLC.(“the Company”) owns and operates www.aqaar.com (“the Website”), the latest end-to-end Property Portal from Dubai connecting real estate buyers, investors, lessors, sellers and agencies. Aqaar enables developers, property managers, homeowners and authorized brokerages to list offplan and secondary market properties. The portal also brings in users to view listings that includes short-term and long-term rentals which facilitates the User to complete their transactions online.

By using the Website, you agree to comply with the following terms and conditions (“the Terms of Use”), our privacy policy and any other documents that may be referred to herein. If you wish to use this Website, you (“the User”) must agree to the terms below as the exclusive basis which governs usage of the Website. Please do not use the Website if you do not agree with the Terms of Use.

We may update the Terms of Use at any time at our discretion. Changes, if we make, will be timely reflected on the Website, so you are requested to check back regularly. Your continued usage of the Website will constitute your acceptance, and agreement, to any changes made within the Terms of Use or of any other documents that may be referred to herein.

The headings provided within the Terms of Use are solely for convenience and are not mentioned in any particular order of significance.

The Company, in its discretion, may assign or enforce the Terms of Use at any time without due notice to you. The delay or failure to exercise or enforce any right or provision of the Terms of Use will not be interpreted as a waiver of such right to act. We shall not be responsible for any breach of these Terms of Use caused by circumstances beyond our reasonable control.

1. Registering with Aqaar.com

1.1 By creating an account, you agree that you are signing up with Aqaar.com in good faith and warrant that the details you provide on registration are true, current and accurate. You must create a password when you register, and you are responsible for maintaining the confidentiality of that password.

1.2 You agree that any person to whom your password is disclosed is authorized to act on your behalf for the purpose of interacting with the Website. You will be responsible for all activity conducted using your account and you shall take reasonable steps to prevent unauthorized access to your account via any computer or device that you use to access your account.

1.3 You are given the opportunity to opt in to receive marketing emails from Aqaar or its business partners. You can manage your email subscription preferences via the Website or unsubscribe from emails altogether. However, the Company may need to send you service emails relating to your account infrequently, and we reserve the right to do so.

1.4 By submitting content on our Websites or otherwise providing material to us ("Content"), you grant us a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, and fully transferable license to use, reproduce, display, sell and modify the Content. We will not pay you any fees for the Content and reserve the right to remove or modify any Content at our sole discretion. We will permit you to post the Content on our Websites in accordance with the Company’s practice and procedures, provided that the content is not illegal, obscene, abusive, defamatory or otherwise objectionable to the best understanding of Aqaar. Any personal data that you provide via, or in connection with, the Website will be governed by our privacy policy.

2. Service Offerings

2.1 The content and details provided within the Website are for general information only. The Website provides a service where real estate agents (“Agents”) may market their products and offerings to you as a potential customer. Agents that post extended details of their products are solely responsible for their accuracy and for fielding enquiries relating to those products.

2.2 The Company does not participate in any direct form of communication between you and the Agents throughout the property transaction. However, you authorize the Company to provide your name and contact information and other identifying information you provide to the applicable real estate agent should you choose to contact an Agent via the Website.

2.3 We host the details in good faith, but we may not verify them, and we make no representations, warranties or guarantees about the quality, accuracy, completeness and reliability of any information and content contained therein.

2.4 The Company does not act as a real estate agent for you or any other user. The Company does not sell, buy, or negotiate the purchase, sale, or exchange of real estate property or otherwise aid or assist in the sale or rent of any real estate property. We do not provide you with any investment or financial advice with respect to the content presented on the Website, nor do we recommend or endorse any properties, products or content within the Website.

3. Contributions

3.1 In these Terms of Use, contributions (“Contributions”) refers to any information or material including data, text, video, still images, audio or other material that we have permitted you to host, share, publish, post, store or upload on our Website.

3.2 In registering for this website, the User hereby authorizes Aqaar to use any or all Contributions which it submits to this Website to inform the User of special offers and for other marketing and related purposes. Aqaar will not use User data for any other purposes than as set out in this Agreement except that Aqaar may disclose this data if compelled to do so by law, or at the request of a law enforcement agency or governmental authority.

3.3 By submitting Material on the Website, User grants Aqaar a royalty-free, perpetual, irrevocable and non-exclusive right and license to use, reproduce, distribute, display, publish, modify, and create derivative works from the Material and publicly perform the User’s Contributions throughout any medium.

3.4 Aqaar permits the User to post Material on the Website in accordance with Aqaar’s procedures provided that Material is not illegal, misleading or deceptive, materially incorrect, obscene, abusive, threatening, defamatory or otherwise objectionable.

3.5 Aqaar reserves the right in its sole discretion to remove or edit the Material at any time if we consider that those Materials are in breach of any law or regulation, misleading or deceptive, inappropriate to the purpose of our Website or corrupted.

3.6 The User also grants Aqaar the right to represent and warrant that the User owns and controls all of the rights to the Contributions; or User has the lawful right including all necessary licences, rights, consents and permissions to use and authorise us to display the Contributions in public.

4. User Behaviour and Obligations

4.1 Any person who can access, provide or avail, services offered by the Website, which includes the following but not limited to hosting, publishing, sharing, transacting, displaying or uploading information or views (“the User ”) shall avail such services solitarily for lawful purposes.

4.2 Not with standing any other provisions of the Terms of Use, as the User, you agree not to:

      a.  Hack, attempt to hack, modify, decompile, disassemble or create derivative works out of the Website or any part it unless explicitly authorized by Aqaar in writing.

      b.  Disrupt, disable, modify, tamper with any program code, data, copyright or other proprietary information belonging to Aqaar and / or its licensors.

      c.  Use your access to the Website, or information gathered from it, for the sending of bulk email on behalf of Aqaar and / or its licensors in the absence of authorization in writing.

      d.  Use automated programs including, but not limited to, web crawling or screen scraping software or any similar technology to access the Website, for the purpose of collecting, and/or accumulating data or content of the Website that may lead to a compromise or a security breach. Search Engines are not permitted to query or index parts of the Website that is protected by security verification system.

5. Privacy Policy

5.1 The Company may use personally identifiable information provided by you to improve the Website and its service offerings. Please refer to the Privacy Policy for more information.

6. Liability Limitation

6.1 The Company does not guarantee or represent that your use of the Website will be uninterrupted or error-free, and you agree that from time to time the Company may remove or cancel parts of the Website for indefinite periods of time, or otherwise limit or disable your access to the Website without explicit notice to you for carrying out scheduled maintenance or upgrade work.

6.2 You expressly agree that your use of the Website is at your sole risk. The Website and all its content are provided "as is" and "as available" for your use, without either express or implied warranties of any kind. Aqaar makes no definite assurances as to quality, suitability, compatibility, reliability, accuracy, completeness and / or timeliness of the Content accessible on the Website. It is your responsibility to evaluate the quality, accuracy, completeness and reliability of any information and content contained therein.

6.3 The Company does not guarantee or represent that the services will be free from loss, corruption, viruses, or other security intrusion, and you hereby release the Company from any liability relating thereto.

6.4 We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Website or by you downloading the Content on it, or on any website linked to it.

7. Indemnification

7.1 You agree to indemnify, defend and hold the Company, its affiliates and their respective shareholders, directors, employees, agents, licensors and / or suppliers harmless from all claims and / or demands, made by any third party arising out of your use of the Website; through your password, or by the violation of the Terms of Use or the infringement of any intellectual property by you.

8. Intellectual Resources

8.1 You agree that the Website including, but not limited to, its content, graphics, user interface, audio clips, video clips, editorial content, and software used to function the Website, contain proprietary information that is owned by ©2016-19 Aqaar Network FZ LLC.and / or its licensors which are protected by applicable intellectual property laws, including but not limited to copyright.

8.2 You agree that you will not use such proprietary information or materials in any manner whatsoever except for personal or non-commercial uses which are in compliance with the Terms of Service and all other documents that are referred to herein. 8.3 The Aqaar name, its logo, and other Aqaar trademarks and graphics, used in connection with the Website are trademarks of ©2016-19 Aqaar Network FZ LLC.and its licensors. You are granted no right or license with respect to the usage of any of the said trademarks.

9. Governing Law and Jurisdiction

9.1 The Terms of Use are governed by the laws of the United Arab Emirates. You agree to submit to any jurisdiction in local or federal courts, whichever applicable, in the Emirate of Dubai for all disputes, claims and conflicts arising in connection with the Website or the Terms of Use.

9.2 If any provision of the Terms of Use is found to be unenforceable by the law, it will be replaced with a provision reflecting the intent of the original provision, and the remainder of the Terms of Use will remain valid and enforceable.

10. Payment Policy

10.1 Aqaar Network FZ-LLC accepts payment by Visa or Mastercard debit and credit cards in AED for our services

10.2 We will not trade with or provide any services to OFAC and sanctioned countries

10.3 Customer using the website who are Minor /under the age of 18 shall not register as a User of the website and shall not transact on or use the website

10.4 Cardholder must retain a copy of transaction records and Aqaar Network FZ-LLC policies and rules

11. Customer Feedback and Quality Assurance

The Company, in its capacity, will ensure that all customer feedback is dealt with fairly and consistently. We welcome any suggestions that you make about how we may improve our service.
